Terms of Service

Welcome to ForkMark! These Terms of Service ("Terms") govern your access to and use of the ForkMark mobile and web apps, our website, and related services (collectively, "the Services").

1. Acceptance

By downloading, installing, accessing, or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Services.

2. What ForkMark Is

ForkMark is a personal restaurant journal with social recommendations. You can log restaurants you've visited, save places to try, discover nearby spots, and share recommendations with friends you add inside the app.

3. Accounts

To use the App, you must create an account with a valid email address. You are responsible for the activity that happens under your account and for keeping your credentials secure. Notify us immediately of any unauthorized use.

ForkMark is currently in private beta and access is by invitation or admin approval. We may limit or revoke beta access at our discretion.

4. Subscriptions and Payments

ForkMark is free during beta. We may introduce paid tiers (e.g., ad-free) in the future. If we do, payments will be processed by the Apple App Store or Google Play Store under their respective terms. We won't charge you anything without notice and consent.

5. User Content

You keep all rights to the content you create in ForkMark — journal entries, recommendations, photos, notes, and ratings. By using the cloud features you grant ForkMark a limited license to store, transmit, and display your content solely to provide the Services (e.g., syncing across your devices, showing a recommendation to a friend you've added).

Recommendations you publish are visible to your friends inside the app. You can delete them at any time. Journal entries remain private unless you explicitly share or recommend them.

6. Friends

Adding a friend is mutual and requires both sides to accept. When you accept a friend request, you agree that your display name, username, ForkMark ID, and (if set) profile photo are visible to that friend, and that recommendations you publish will appear in their feed.

You can remove a friend at any time. Removal is mirrored on both sides.

7. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable laws
  • Impersonate another person or misrepresent your affiliation with anyone
  • Submit content that is hateful, harassing, defamatory, or sexually explicit
  • Upload photos you don't have the right to share
  • Attempt to gain unauthorized access to other users' accounts or data
  • Interfere with or disrupt the Services, servers, or networks
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use automated systems or bots against the Services

We may remove content or suspend accounts that violate these rules.

8. Third-Party Data

Restaurant discovery uses Foursquare Places and OpenStreetMap. Place names, addresses, and category data belong to those providers and are shown under their respective licenses. We are not responsible for the accuracy of third-party place data.

9. Intellectual Property

The ForkMark name, logo, and app design are our property. You may not reproduce, distribute, or create derivative works without written permission.

10. Data Security

We take security seriously. Data in transit is protected by HTTPS/TLS; data at rest is encrypted by Google Firebase. However, no system is perfectly secure. You use the Services at your own risk. See our Privacy Policy for details.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORKMARK AND ITS OPERATORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, INCLUDING LOSS OF DATA, LOSS OF REVENUE, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS, OR (B) TWENTY-FIVE U.S. DOLLARS.

13. Indemnification

You agree to indemnify and hold ForkMark and its operators harmless from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of a third party's rights.

14. Termination

We may suspend or terminate your access to the Services at any time, with or without cause. Upon termination, your right to use the App ends. Cloud-synced data will be retained for 30 days after account deletion to allow recovery, then permanently removed.

15. Changes to These Terms

We may modify these Terms from time to time. We'll post the updated Terms here with a new "Last updated" date. Continued use after changes indicates your acceptance.

16. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Disputes will be resolved through binding arbitration under the American Arbitration Association rules, unless you opt out within 30 days of accepting these Terms by emailing us.

17. Severability

If any provision of these Terms is unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions remain in full effect.
